Lasting Power of Attorney

A Power of Attorney is a document appointing a person (an 'Attorney') to manage the affairs of another person (the 'Donor').

What is a "Lasting Power of Attorney"

Until October 2007, it was possible for a person to obtain an Enduring Power of Attorney to enable them to handle the affairs of another person. From October 1 2007, the Enduring Power of Attorney was supplemented by the addition of a "Lasting Power of Attorney". Both types of power of attorney can be still used.

  1. Enduring Power of Attorney - An Enduring Power of Attorney created before October 2007 - can still continue to be used today.
  2. Lasting Power of Attorney (LPA) - created after 1 October 2007 - gives more protection and extra options
There are two types of LPA's
  1. Property and Affairs - A Property and Affairs LPA enables an attorney to make decisions on the donor’s behalf about such things as paying bills, collecting income and benefits or selling property.
  2. Health and Welfare - A Health and Welfare LPA allows an attorney to make decisions about such things as consenting to medical treatment or deciding where to live.
How to find out more and to register for a "Lasting Power of Attorney"

A Lasting Power of Attorney should be registered with the Office of the Public Guardian. To register a Lasting Power of Attorney you need to complete the forms in the registration pack. The registration pack can be downloaded from the Ministry of Justice website using the link below.

What to do if you already hold "Power of Attorney" (POA)

If you already hold a Power of Attorney for a member of the Lafarge UK Pension Plan and would like to deal with their affairs and correspondence regarding their pension, then please send us a copy of the Power of Attorney to the address below, along with a covering letter quoting the pension referance number or National Insurance number so we are able to update our records and deal with the attorney direct. Any original copies will be returned to you by recorded delivery.
